Appeals-Trial Court/Publications


Mike has served as lead counsel or co-counsel in numerous federal and state appeals.  In the federal courts, Mike has served as counsel in cases before the Supreme Court of the United States, the United States Courts of Appeals for the Fifth. Seventh, and Federal Circuit Courts of Apeals, and various other federal appellate tribunals.  At the state level, Mike has served as counsel in numerous cases before the Supreme Court of Texas, the majority of the Texas appellate court districts, and in appeals in Michigan and California.  A full list of Mike's appellate appearances is found here.

Trial Court

Mike also serves as counsel in the trial court, handling dispositive motions, jury charges, and general issues of error preservation. Some of his recent engagements have included:preparing the jury charge and arguing the charge conference in one of Travis County's largest premises liability cases preparing summary judgment briefing in a substantial negligent hiring case preparing the jury charge and arguing the charge conference in a multi-million dollar commercial casepreparing and arguing post-verdict motions in negligence casehandling all dispositive motions, charge issues, and other error preservation issues in breach of fiduciary duty case.


Mike is a frequent speaker on appellate-related issues.  He has published book chapters and law review articles on topics such as class actions, practice before the Supreme Court of Texas, and appellate procedure at the Fifth Circuit Court of Appeals.  For many years he wrote an annual  update on matters before the Supreme Court of Texas, and has given numerous presentations and authored numerous articles on appellate practice.  A full list of Mike's publications is found here.
